This Privacy Policy (the “Policy”) describes the manner in which ProEdge Life Coaching (“the Company,” “we,” “us,” or “our”) collects, uses, discloses, and safeguards the personal information of users (“you,” “your,” or “the User”) in connection with the website productivitylifecoach.com (the “Website”) and the coaching services provided by the Company (the “Services”). By accessing the Website or engaging the Services, the User acknowledges that they have read and understood the terms of this Policy.

 

This Policy is intended to operate in accordance with applicable data protection legislation, including the Digital Personal Data Protection Act, 2023 (India) (the “DPDP Act”), the EU/UK General Data Protection Regulation (the “GDPR”), and the California Consumer Privacy Act, as amended (the “CCPA/CPRA”), in each case to the extent applicable to the User.

1. Data Controller

ProEdge Life Coaching is a productivity and accountability coaching practice operated by ProEdge Life Coaching, having its principal place of business in India. For the purposes of applicable data protection law, the Company acts as the data controller and is responsible for the personal information processed under this Policy. 2. Information We Collect

2.1 Information Provided Directly by the User. The Company collects personal information that the User voluntarily provides, including the User’s name, email address, telephone number, and any further details submitted when booking a call, completing the contact form, subscribing to the newsletter, or purchasing a program. Where the User purchases Services, payment is processed by a secure third-party payment processor; the Company retains basic transaction records but does not store the User’s full payment-card details.

2.2 Coaching Information. In the course of receiving the Services, the User may disclose personal context relating to their goals, work, habits, and challenges. Such information is collected solely for the purpose of delivering the Services and is treated as confidential in accordance with Section 8.

2.3 Information Collected Automatically. When the User accesses the Website, the Company automatically collects certain technical information, including the User’s IP address, browser type and version, operating system, referring source, and pages viewed. Such information is collected by means of cookies and analytics technologies, as described in Section 6.

3. Purposes of Processing

The Company processes personal information for the following purposes:

(a) to respond to inquiries and to schedule discovery and coaching calls;

(b) to deliver, personalize, and improve the Services and related resources;

(c) to process payments and maintain accurate records;

(d) to send the newsletter and related communications, where the User has opted in;

(e) to operate, maintain, and improve the Website; and

(f) to comply with the Company’s legal, tax, and regulatory obligations.

The Company does not sell or rent personal information, and shall not disclose the contents of any coaching engagement for marketing purposes.

4. Legal Basis for Processing

The Company processes personal information on one or more of the following legal bases: (a) the User’s consent, in respect of marketing communications and non-essential cookies; (b) the performance of the coaching agreement between the Company and the User; (c) the Company’s legitimate interests in operating and improving its business; and (d) compliance with legal obligations to which the Company is subject.

Where processing is based on consent, such consent is obtained through an affirmative action of the User, including subscribing, booking, or accepting cookies, and may be withdrawn by the User at any time, without prejudice to Services already rendered.

5. Disclosure to Third Parties

5.1 Service Providers. The Company may disclose personal information to trusted third-party service providers who process such information on the Company’s behalf and in accordance with their own privacy obligations. Such providers include Google Analytics (analytics), Calendly (scheduling), kit.com (email communications), and Paypal & Cashfree (payment processing). The Company discloses only such information as is necessary for each provider to perform its function.

5.2 Legal Disclosures. The Company may disclose personal information where required to do so by law, court order, or governmental authority, or where necessary to establish, exercise, or defend its legal rights.

5.3 Business Transfers. In the event of a merger, acquisition, reorganization, or sale of assets, personal information may be transferred to the successor or acquiring entity, in which case the Company shall notify the User of any material change in the handling of such information.

6. Cookies and Tracking Technologies

The Company employs cookies and similar technologies to ensure the proper functioning of the Website, to retain the User’s preferences, and to analyze usage of its content. Non-essential cookies, including analytics cookies, are deployed only with the User’s consent, which may be managed through the Website’s cookie banner or the User’s browser settings. The disabling of certain cookies may affect the functionality of the Website.

7. Data Retention

The Company shall retain personal information only for as long as is necessary to fulfill the purposes set out in this Policy and to satisfy applicable legal obligations, which shall ordinarily comprise the duration of the User’s relationship with the Company together with any further period required for tax or record-keeping purposes. Upon expiry of the applicable retention period, personal information shall be securely deleted or anonymized.

8. Security and Confidentiality

The Company implements reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction, and engages only reputable service providers. The confidentiality of the coaching relationship is fundamental to the Company’s practice, and information disclosed in the course of the Services shall be kept private. Notwithstanding the foregoing, the User acknowledges that no method of transmission over the internet is entirely secure, and the Company cannot guarantee absolute security.

9. Rights of the User

Subject to the User’s jurisdiction and applicable law, the User may be entitled to:

(a) access the personal information held by the Company;

(b) rectify inaccurate or incomplete information;

(c) request erasure of personal information, subject to the Company’s legal obligations;

(d) withdraw consent or opt out of marketing communications at any time;

(e) object to or restrict certain processing;

(f) request a portable copy of personal information; and

(g) in the case of residents of California, opt out of any “sale” or “sharing” of personal information.

To exercise any of the foregoing rights, the User may contact the Company at [your email]. The Company may require verification of the User’s identity prior to acting upon any such request and shall respond within the period prescribed by applicable law. Where the User considers that their personal information has been mishandled, the User is further entitled to lodge a complaint with the competent supervisory authority, including the Data Protection Board of India or a relevant supervisory authority within the European Union or the United Kingdom.

10. International Data Transfers

The Company provides Services to clients worldwide. Where the User accesses the Website from outside India, personal information may be stored or processed in India or in other jurisdictions in which the Company’s service providers operate. In each case, the Company shall take appropriate steps to ensure that such information is protected in accordance with this Policy and applicable law.

11. Children’s Privacy

The Services are intended for individuals aged eighteen (18) years and above. The Company does not knowingly collect personal information from minors. Should the Company become aware that personal information has been collected from an individual under the age of eighteen (18), it shall take steps to delete such information promptly.

12. Third-Party Links

The Website may contain links to third-party websites that are not operated or controlled by the Company. This Policy applies solely to the Website, and the Company assumes no responsibility for the privacy practices or content of such third-party websites. The User is encouraged to review the privacy policies of any such websites before providing personal information.

13. Amendments to This Policy

The Company reserves the right to amend or update this Policy from time to time in response to changes in its practices, tools, or legal requirements. The Company shall revise the “Effective Date” above and, in the case of material changes, shall provide the User with reasonable notice. The User is encouraged to review this Policy periodically.
